You should file against him soon before the limitation runs out, or he leave and you can't se penea him. In many states a car has an implied warranty...that means that even though the car was sold as it, it is still expect to work to a certain degree. You need to get the ad for the car and if is said something like "good condtion" low miles, new engine, new brakes and it did not have all of those things then you have a case. If he sold it too you as is and told you it was just junk and there is nothing in writing to say it was not, then you don't have a case.
