Insurance Registration : If I Hit An Unlicensed Driver Is My Insurance Required To Pay For His Car
My friend got into an accident with an unlicensed driver and when the cops showed up they said no one could be determined to be at fault. They said the insurance companies could duke it out. If my friend is found to be at fault, is her insurance required to pay to fix the car of the unlicensed driver? ~~~ Shawna M ~~~

I had a similar situation a couple fo years ago so things might have changed since then. I was found to be at fault in the accident (because of a stupid state law, if you hit a car in the rear it is automatically your fault, even if they cut you off and slam on their brakes), the other person was driving a car with no license and no insurance but because the cops deemed me at fault my insurance company had to pay and after that my insurance rates went through the roof...it is unfair especially since the unlicensed driver isn't even suppose to be on the road.

If they do not have a license then they probably don't have insurance.. in that case your friend best have uninsured motorist on the policy.

It does not make that person automatically at-fault for the accident. People run red lights, speed, field to yield the right of way, all of which are "illegal" acts. If you run a red light and struck an unlicensed driver, you are still at fault, because you were negligent/liable. Stupid to drive a car without being licensed, but that does not bar you from recovery if you were not at fault for an accident.
