My brother recently was involved in a minor car accident in his work truck. He works for a company that delivers furniture. The other day he was reversing out of a customers driveway and accidently hit a fire hydrant causing minor damage but still it cost a lot ot repair and apparently the excess for the insurance is $1700 to cover the repairs. His employer has informed him that he must pay the $1700. He has never signed an AWA or anything stating that in the event of a work related accident would he be liable to pay the excess. Does anyone know where i could find any regualtions or laws so that i could pass this onto the boss so that he stops trying to rot my bro out of money. This accident happened in WA if that helps.?? any help would be greatly appreciated. as this is the second time his boss has tried to take money out of people pays for excess's. ~~~ help wanted ~~~

First off, An employer is not allowed (legally) to take ANY money out of an employees pay check without written permission from the employee (with the exception af taxes and child support.) Even health have to sign the papers allowing the deduction for health insurance. Anything else deducted such as what you are ststing is illegal. Your state has a labor relations them and they WILL handle it. You can get the number from your local employment office. The boss is required to have insurance on the vehicle to cover such things. I had an accident once and I agreed to cover the deductable which was $1, .I agreed to do this as the accident was totally my fault. If your bro's boss cannot collect through pay checks, then his only option is to file a claim in civil court,which he probably will not do because he will have to pay to file and he will not be able to . a judge which means he has little chance that he will win the case. I think your Bro should probably pay what ever amout the boss' insurance has a a deductable,but nothing more. This is the minimum that the courts would hold him liable for.
