I am in the early stages of divorce in NC. I recently recieved money from an inheritance. With that I purchased a vehicle and some land. They are soley in my name and all inheritance monies were kept in a seperate account. ~~~ cowgirlkicknit ~~~

Generally speaking, as long as the funds were kept separate (ie not deposited into a joint account) and the spousea€™s name is not on the property, then it would be considered separate property and would not be subject to division. North Carolina Statutes 50-20: "Separate property" means all real and personal property acquired by a spouse before marriage or acquired by a spouse by bequest, devise, descent, or gift during the course of the marriage. Discuss the situation in detail with a local attorney, because there may be exceptions. For example, he/she might be entitled to half of the increase that occurred in the value of the property, especially if you used martial funds to make improvements, maintain the property, etc.

With that I bought a home that was solely in my name. When going through the divorce I would have had to sell the house and split the profit with my ex. Luckily, he was nice (ha,ha) and said I could have the house because of the circumstances in which I got it. If not a 50-50 state you may be in luck and get to keep all of it without any problems. If the ex is decent, she doesn't have to ask for something she knows came from your family, but if she is greedy..well good luck!!
