Renting Real Estate : What Do I Do If The Owner Does Not Respect The Tenancy Agreement
I had signed a tenancy agreement with the owner and agent to move into a house that i rented on the 3rd of february. Now the owner is requesting me to move in only on the 15th of February and this is not possible for me as i have to vacate my current house on the 3rd february. What do i do if the owner insists on this? I have also paid my agent the full commission and he too seems to be playing tricks.. any legal opinions would greatly help. thanks ~~~ suhaan74 ~~~

Answer 1If you have a lease which gives you the right to move in on February 3rd then you should be prepared to move in on February 3rd. If the property is not available to you then you will need to put your belongings into storage and find temporary housing for yourself. The landlord will be responsible for paying for these things but you will need to sue him in small claims and it will be a very bad way to start out a new tenancy. Since you already know that you cannot move in per the lease try to find some place to go and ask the landlord to pay for your inconvenience or ask to be let out of the lease and have all of your money refunded so you can find another place to live.
Answer 2Hiya, Being a Property Agent myself, I know the fustration which you must be going through. Your agent, upon receiving your full commisssion, is supposed to service you to a certain degree of professionalism until the END of your TA (tenancy agreement). By IEA (Institute of Estate Agents) ruling, the agent is not supposed to get commission from both parties unless he is to ensure that both side are made aware and that he will look after the interest of both parties. The first thing to do is to make sure that your agent has done his job by paying for the Stamp Duty for your rental. If this is done, your TA is a binding contract between you and the landlord held by the Laws of Singapore. Assuming that your agent is not "green", he should know that the TA is a binding contract and a breach or default will constitute to the "victim" being eligible for compensation. Do check your TA carefully to make sure that your commencement date is on the 3rd. If that is the case, get your agent to tell the landlord to either let you move in by the 3rd or the landlord is liable to pay for the damages (additional rental / accom, time lost., etc) from the 3rd to the 15th. Your agent should be the one doing the negotiation and telling you your rights. If you agent comes from a larger Broker company (like ERA, sorry for the commercial), they will have a legal department which can help you and the agent in cases of complication.
