Trademark it () and buy the URL asap. Other companies can use the same name, but not in the same industry (the test is "consumer confusion", so I can start McDonalds Plumbing, but not McDonalds Pizza).

Answer 10First you have to make sure no one else has come up with it. You apply for a business license using that name. You also need to realize that there is a state and a federal business name registry, so you might want to check both.
